Which project does the investor self-organize the acceptance test?

Point dd, Clause 1, Article 32 of Decree No. 46/2015/ND-CP stipulates 2 objects of works, including (1) transmission lines and substations with voltage level of 35KV or less, (2) works If the investor is using non-budget state capital, the investor shall organize the acceptance test by themselves according to the provisions of this Decree.

As reflected by Mr. Tran Xuan Tai (Quang Binh), Point dd Clause 1 Article 32 of Decree No. 46/2015/ND-CP stipulates: “Particularly for transmission line and substation works with voltage level from 35kV and below, for grade IV works funded with non-budget state capital, the investor shall organize the acceptance test by themselves according to the provisions of this Decree. The investor is responsible for reporting the results of the above-mentioned acceptance test to the specialized construction agency according to the decentralization at Point c, Clause 2 of this Article for synthesis and monitoring.

Mr. Tai asked, the above regulation is understood as the investor self-organizing the acceptance test for: All works of transmission lines and substations with voltage level of 35kV or less. Grade IV works using non-budget state capital? Or, investors themselves organize the acceptance test for projects using non-budget state capital, including: Line works, transformer stations with voltage level of 35kV or less; grade IV works?

The Ministry of Construction responded to this issue as follows:

On January 26, 2021, the Government issued Decree No. 06/2021/ND-CP detailing a number of contents on quality management, construction and construction maintenance. This Decree takes effect from the date of signing for promulgation and replaces Decree No. 46/2015/ND-CP dated May 12, 2015 of the Government on quality management and maintenance of construction works. At any time when construction investment activities are implemented, the law in force prescribed at that time and relevant transitional handling regulations shall apply.

The inspection of the acceptance of construction works is specified in Article 24 of Decree No. 06/2021/ND-CP and related regulations on transitional handling in Clauses 2 and 3, Article 53 of this Decree.
